Notice of Passing of Interim Control By-law 25-2026 as an extension to By-law 24-2025
The Council of the Town of Kingsville extended By-law 24-2025 on April 13th, 2026
Take Notice that the Council for the Corporation of the Town of Kingsville passed By-law 25-2026, being a by-law to extend By-law 24-2025 on the 13th day of April 2026, pursuant to Section 38(2) of the Planning Act, R.S.O. 1990, c.P.13, as amended.
And Take Notice that Interim Control By-law 24-2025, will be in effect for a period of additional one (1) year from the date of extension, lapsing on April 13th, 2027. The Council or the Planning Board has authority to repeal the by-law at an earlier date.
Purpose & Effect of By-law 25-2026
The purpose of By-law 25-2026 is to extend Interim Control By-law (By-law 24-2025) for a period of one (1) year to provide the Town with an opportunity to undertake a Comprehensive Sewer Use By-law, substantially complete the Water and Wastewater Servicing Master Plan to confirm servicing capacity, and review land use planning policies related to the Ruthven Sanitary System.
The effect of By-law 25-2026 is to prohibit any new development that would discharge into the Ruthven Sanitary System or require a connection to discharge into the Ruthven Sanitary System, attached as Schedule “A” to this notice for an additional year. This by-law allows for the issuance of building permits on residential and industrial buildings within existing plans of subdivision.
Process of Filing an Appeal to the Ontario Land Tribunal (OLT)
Any person or public body who was given notice of the passing of a by-law under subsection (3) may, within 50 days after the date of the passing of the by-law, appeal to the Tribunal by filing with the clerk of the municipality a notice of appeal setting out the objection to the by-law and the reasons for support of the objection.
Only individuals, corporations, and public bodies may appeal an interim control by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
If a Town Council decision is appealed to the OLT, you may request participant status and make written submission to the OLT for consideration as part of the decision-making process.
If you intend to appeal, a Notice of Appeal must be filed with the Town of Kingsville Clerk, located at:

The Notice of Appeal must be filed no later than 4:30 p.m. on June 2, 2026, and shall include:
1. Reasons for the appeal;
2. A completed OLT A1 Appeal Form. Currently the Town of Kingsville is not registered with the OLT’s e-file portal, therefore appellants must complete and submit the A1 Appeal Form to the Town of Kingsville Clerk;

3. The fee required by the Tribunal;
A fee in the amount of $400.00 (fee for a private citizen, a registered charity or a non-profit ratepayers’ association) or $1,100.00 (Corporate Fee), pursuant to the Ontario Land Tribunal Act, 2021, S.O. 2021;
Fees are payable by certified cheque, money order, or credit card, and must be in Canadian funds; and,
Certified cheques and money orders should be made payable to the “Minister of Finance” and submitted to the municipality at the time of submission of the OLT Appeal Form.
Note: For credit card fee payment, please indicate this on the appeal form and OLT staff will phone you to complete the transaction – do not record any credit card details on the appeal form. The municipality will not collect the credit card fee payment. Credit card fees are collected by OLT directly by contacting the appellant.
